Hofer Hofer Limited operating as Modern Planner (“Modern Planner”, “we”, “us”, “our”) is dedicated to maintaining your privacy and protecting your personal information online. We work to protect your personal information and maintain your privacy through your use of our websites. This Privacy Policy (this “Policy”) is between Modern Planner and the User (“user”, “you”, “your”). 

This Policy describes how your personal information is collected, used, and shared when you visit, register with, or make a purchase from 1) modernplanner.com, and 2) any other website or mobile application to which this Policy is attached (collectively the “Site”). 

 

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we or a third-party automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we or a third-party collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. When you register on, make a purchase, or attempt to make a purchase through the Site, we or a third-party payment processor collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”.

Some of the third-parties that we may obtain Device Information and Order Information from include, without limitation, Typeform, Google Forms, Acuity Scheduling, Thinkific, Shopify and/or PayPal. If Personal Information is provided to us by a third-party, the provider of such information represents that they have all necessary authority and/or have obtained all necessary consents to enable us to collect, use and disclose such Personal Information for the purposes set out in this Policy. 

When we talk about “Personal Information” in this Policy, we are talking both about Device Information and Order Information.

 

SENSITIVE INFORMATION

We ask that you not send us, and you not share with us any sensitive Personal Information (e.g., Social Security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, criminal background or trade union membership).

 

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

Communicate with you;

To deliver services, such as information or newsletters;

Screen our orders for potential risk or fraud; and

When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

 

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above. Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

 

YOUR RIGHTS

You have the right to request access to the Personal Information we hold about you and to ask that your Personal Information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below. In order to comply with your request we may ask you to verify your identity. We will fulfill your request to access your Personal Information by sending an electronic copy, unless your request specifically identities a different manner of delivery. 

Please note if you are visiting the Site from outside of Canada, please be aware that you are sending your Personal Information outside of your country of residence to Canada.  That Personal Information may be transferred within Canada to the United States or to other countries outside of your country of residence. These countries may not have personal information and data protection laws as comprehensive or protective as those in your country of residence; however, our collection, use and storage of your Personal Information will at all times be governed by this Policy.  

 

DATA RETENTION

We only retain your Personal Information for as long as we are providing services to you or otherwise for a limited period of time as long as we need to fulfill the purposes for which we have originally collected the Personal Information, unless otherwise required by law. We will retain and use Personal Information as necessary to comply with our legal obligations, resolve disputes and enforce our contracts.

 

CHANGES

We may modify, supplement or update this Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

 

CHILDREN’S ONLINE PRIVACY PROTECTION ACT

The Site and any products and services offered therein are not intended for persons under the age of 16. Modern Planner does not knowingly collect information from anyone under 16 years of age. Modern Planner prohibits children under the age of 16 from using all interactive portions of this website, including leaving any comments, filling out forms, or otherwise submitting information. Modern Planner will not knowingly collect personally identifiable information from children under 16. If Modern Planner learns it has any information or content from anyone under the age of 16, it will delete that information.

 

ASSIGNMENT

In the event that all or part of Modern Planner’s assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the Personal Information collected via the Site.
